Metro by T-Mobile Brick Safari SWEEPSTAKES RULES (“Sweepstakes Rules”) NO PURCHASE NECESSARY TO ENTER OR WIN. SUBJECT TO APPLICABLE FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS. VOID WHERE PROHIBITED.
HOW TO PLAY. No purchase necessary to enter the Metro by T-Mobile Brick Safari Sweepstakes. To enter the Metro by T-Mobile Brick Safari Sweepstakes (“the Sweepstakes”), participants must complete and submit the online form located on our webpage www.CZS.org/MetrobyT-Mobile between 12:00 p.m. CST on July 1, 2019 and 11:59 p.m. CST on September 29, 2019. Participants must provide all required information in his/her online submission including, but not limited to, his/her complete legal name, age, residence, and valid email address. Incomplete entries and multiple entries will not be considered; participation is limited to one online submission per eligible person.
WINNER SELECTION, NOTIFICATION, AND ACCEPTANCE. One (1) winner (“Winner”) will be selected on the following dates: July 31, 2019 (from entries received from 12:00 p.m. CST on July 1, 2019 through 11:59 a.m. CST on July 30, 2019), August 30, 2019 (from entries received from 12:00 p.m. CST on July 31, 2019 through 11:59 a.m. CST on August 29, 2019) and September 30, 2019 (from entries received from 12:00 p.m. CST from August 30 through 11:59 a.m. CST September 29, 2019). Winning entry will be selected from the online submissions in a random drawing. Winner(s) will be notified via email at the email address provided by Winner(s) in his/her online submission at the time of entry. Return of any prize notification as undeliverable for any reason will result in disqualification. Winner(s) may be asked to confirm and verify his/her identity and complete an affidavit of eligibility, acceptance, and compliance with the rules of the Sweepstakes within seven (7) days. Winner(s) may be required to provide additional documents including, but not limited to, a completed IRS W-9 form, release, and other information and documents. Failure to timely sign and return the affidavit or other requested documents may result in Winner(s)’ disqualification, the forfeiture of his/her interest in the prize(s), and the award of the prize(s) to substitute Winner(s) (i.e., another randomly-selected, eligible participant in the Sweepstakes). Winner(s)’ right to redeem any and all prizes are subject to his/her compliance with all Sweepstakes Rules set forth herein as well as any applicable federal, state, local, and municipal laws and regulations.
PRIZE(S). A total of three (3) prize packages will be given away. Each winner will receive the Metro by T-Mobile Brick Safari Prize Package (ARV: $537.80), which includes the following:
· One (1) behind the scenes tour of an animal exhibit for up to four (4) people, ages 10 and over, at Brookfield Zoo, located at 3300 Golf Road, Brookfield, IL 60513;
· One (1) parking pass, four (4) general admission passes, and four (4) passes to all open attractions, to Brookfield Zoo, located at 3300 Golf Road, Brookfield, IL 60513.
· Except as provided above, the prize(s) does not include payment or reimbursement for additional transportation expenses, meals or other costs which may be incurred due to participation in the Metro by T-Mobile Brick Safari prize package. Winner(s) may not substitute prizes, and prizes are not transferrable, assignable, or redeemable for cash. Winner(s) agree to be solely responsible for all applicable federal, state and local taxes, fees and surcharges in connection with the acceptance and use of the Sweepstakes prize(s), if any. Sweepstakes prize(s) are to be redeemed and used by December 31, 2019; the specific dates for the behind the scenes tour are to be mutually agreed upon by Winner and Sponsor and subject to availability.
SPONSOR. The Metro by T-Mobile Brick Safari Sweepstakes is sponsored and administered solely by the Chicago Zoological Society at Brookfield Zoo (“Sponsor”). MetroPCS Michigan, LLC dba Metro by T-Mobile (“Advertising Sponsor”) is the advertising sponsor of this Sweepstakes and is not responsible for its administration. The decisions of Sponsor regarding the selection of Winner(s), the prizes, and all other aspects of the Sweepstakes shall be final and binding in all respects.
ELIGIBILITY. Subject to the restrictions set forth in the Sweepstakes Rules, the Metro by T-Mobile Zoo Sweepstakes is open to all legal U.S. residents. Participants must be age 18 or older to enter and win. Employees and contractors of the Chicago Zoological Society, Brookfield Zoo, the Advertising Sponsor, their respective subsidiaries and affiliates (collectively, the “Sweepstakes Parties”), or any advertising and promotional agencies affiliated with the aforementioned entities, including their employees and agents, as well as their immediate family members are not eligible to enter or win the Sweepstakes. “Immediate family members” means spouses, parents, siblings, and children) and those persons living in the same household as such employees (whether or not related).To qualify, an online submission must provide all requested information and be completed, submitted, and received by Sponsor by the stated deadline. No late entry/submission will be accepted.
GENERAL/ADDITIONAL RULES. In addition to the Sweepstakes Rules set forth above, participants are subject to the following additional rules, terms, and conditions of participation.
Conditions of Participation. By making an online submission, participants agree to be bound by the Sweepstakes Rules and the decisions of Sponsor, which are final and binding upon participants in all respects. Sponsor is not responsible for incomplete, lost, or damaged submissions. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Sweepstakes as solely determined by Sponsor. In the event that the Sweepstakes is compromised by a virus, non-authorized human intervention, tampering, data breach, or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Sweepstakes, Sponsor
reserves the right in its sole discretion to suspend, modify, or terminate the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration, Sponsor reserves the right to award prizes based upon submissions received before the termination date. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the Internet Service Provider (“ISP”) account from which they were sent. For the purpose of the Sweepstakes Rules, an ISP account owner shall mean the natural person assigned to such ISP account the ISP, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account. All costs and expenses incurred in connection with redeeming, accepting, or using a prize that are not specifically provided for herein are solely the responsibility of Winner. No cash equivalents, prize substitutions or transfer of prize permitted except Sponsor reserves the right to substitute a prize of equal or greater value in the event that an offered prize is unavailable.
Release/Limited Liability. Participants agree to release and hold harmless the Sweepstakes Parties, their respective employees and agents, from any and all liability or any injury, loss, or damage of any kind arising from or in connection with their participation in the Sweepstakes or any prize won as a result of participation in the Sweepstakes. Further, participants agree to indemnify and hold harmless the Sweepstakes Parties and their respective employees and agents, representatives, contractors, co-sponsors, and advertisers, from any and all liability, loss, damage, costs or claims related to participation in the Sweepstakes and/or publication of their submission and/or entry information. Sponsor shall not be liable to Winner(s) or any other persons, including participants, for failure to supply the Sweepstakes prizes or any part thereof, by reason of any acts of God; any actions, regulations, orders, requests by any governmental or quasi-governmental entity (whether or not said actions, regulations, orders, or requests prove to be invalid); equipment failure; hacking/data breach incidents, terrorist acts; earthquake, war, fire, flood, explosion, unusually severe weather, epidemic; or other events beyond the reasonable control of Sponsor. In the event of a dispute, participants agree to pay Sponsor’s attorneys’ fees in connection with litigating or otherwise resolving the dispute.
Waiver of Privacy/Consent to Use of Information. By making an online submission, participants consent to the collection, disclosure, and use of the submitted information provided by the participant. By making an online submission, participants grant Sponsor a worldwide, perpetual, irrevocable, royalty-free license to use their information in any manner including for publicity and promotion. By accepting a prize, Winner(s) hereby waives his/her right to privacy with respect to any personal information submitted in connection with acceptance of the Sweepstakes’ prizes. Winner(s) consents to the use of their name, voice, photograph, image, likeness, biographical data, and any information submitted by Winner(s) in advertising, promotional and marketing materials by Sponsor, throughout the world in any media, whether
now or in the future, including on the internet, by Sponsor, its promotional partners and third-party marketing entities, except where prohibited by law.
Disclaimer/Right to Modify, Cancel, or Suspend. Sponsor reserves the right to cancel, modify any dates, or deadlines, or suspend the Sweepstakes for any reason, at any time, without liability.
Construction and Applicable Law. The laws of the State of Illinois shall govern in the event of any dispute arising out of the terms of the Sweepstakes rules. By making an online submission, participants submit to the jurisdiction of the State of Illinois and waive any objection to jurisdiction in the event of a subsequent dispute with Sponsor. The invalidity or unenforceability of any provision of the Sweepstakes Rules shall not affect the validity or enforceability of any other provision or the Sweepstakes Rules as a whole. In the event that any such provision is determined to be invalid or otherwise unenforceable, the Sweepstakes Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
